EULA - End User License Agreement

Shareware Licensing Agreement for PitchScope Navigator PD 2.0
This is a legal agreement between you (either an individual or an entity), the end user, and Creative Detectors regarding use of the software ("PitchScope Navigator PD 2.0") accompanying this Agreement ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Software.
1. GRANT OF LICENSE.
Creative Detectors hereby grants you the right to use the SOFTWARE (PitchScope Navigator PD 2.0) on computers. The SOFTWARE is considered in use on a computer when it is loaded into temporary memory or installed into permanent memory.
2. COPYRIGHT NOTICE.
Copyright 2012-2019 by Creative Detectors, www.creativedetectors.com, all rights reserved. This software (PitchScope Navigator PD 2.0) and its associated documentation are the intellectual property of Creative Detectors of California. PitchScope Navigator PD 2.0 is protected by copyright laws and international treaties.
3. PROPRIETARY RIGHTS.
The SOFTWARE is owned exclusively by Creative Detectors, and this license does not transfer any ownership of the SOFTWARE to you.
4. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
* You may not translate, reverse program, disassemble, decompile or otherwise reverse engineer the SOFTWARE.
* You may not remove any copyright or other proprietary notice from the PitchScope Navigator PD 2.0, or any of its screen displays, or from any of it documentation and help files.
* Modification of Executable. You may not modify the bytes of the executable of the SOFTWARE (PsNavigatorPD.exe).
5. DISTRIBUTION as SHAREWARE.
You may provide copies of PitchScope Navigator PD 2.0 to others so long as you:
* provide exact, unmodified copies of PitchScope Navigator PD 2.0 in the form of the self-installing .exe file(setupNavigatorPD.exe) received from Creative Detectors, including all accompanying files, this Agreement, and all copyright, trademark, proprietary, and other notices;
* do not charge or collect any monetary or other compensation for or in connection with PitchScope Navigator PD 2.0, apart from a modest reproduction or handling fee.

6. NO WARRANTY.
THIS SOFTWARE IS LICENSED TO YOU "AS IS," AND WITHOUT ANY WARRANTY OF ANY KIND, WHETHER ORAL, WRITTEN, EXPRESS, IMPLIED OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
7. LIMITATION OF LIABILITY.
Creative Detectors grants the license to the SOFTWARE hereunder and the END USER accepts the use hereof on an "AS IS" and "WITH ALL FAULTS" basis. Furthermore, the END USER understands and agrees that IN NO EVENT WILL Creative Detectors OR ANY OF ITS SUPPLIERS BE LIABLE TO LICENSEE FOR SPECIAL OR CONSEQUENTIAL DAMAGES which might arise out of or in connection with the performance or non-performance of this Agreement or of the SOFTWARE hereunder, even if Creative Detectors has been advised of the possibility of such damages, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS due to errors, inaccuracies, omissions, incompleteness or insufficiency of the SOFTWARE or materials, nor for the usefulness of the SOFTWARE to the END USER.
In no event shall Creative Detectors' liability related to any of the SOFTWARE exceed the license fees, if any, actually paid by you for the SOFTWARE. Creative Detectors shall not be liable for any damages whatsoever arising out of or related to the use of or inability to use the SOFTWARE, including but not limited to direct, indirect, special, incidental, or consequential damages.
